Electronic signature is no other than digital verification of identity and received entitlements. It must be approved by a certification authority. It’s important to differentiate between signature NOT verified by a qualified certificate and signature verified by a qualified signature. A non-qualified electronic signature is, for example, a common, free Trusted Profile, which can be used by every citizen of Republic of Poland in contacts with public institutions.
A qualified electronic seal is a signature confirmed by a qualified certificate via a device approved by the Ministry of Digital Affairs, which can validate qualified electronic signatures. Therefore, documents signed with the digital certificate has the same legal effect as documents signed traditionally with handwritten signature. In stricly defined situations related to the circulation of electronic legal documents, the qualified electronic signature is required to pass the validation process. Sworn translation certified with a translator’s qualified electronic signature is an equivalent of the traditional translation authenticated with the translator’s signature and seal. The difference is that you can use the sworn translation certified with a digital certification electronically, as well. Remember that the signature must be approved by the authority who can validate electronic signatures.
Authenticated translation can be drafted only by a translator, who has passed a sworn translator exam and was put on the Ministry of Justice’s sworn translators list.
