Marrying a foreigner and what is next?

The marriage season is fast approaching. Undoubtedly, it is the important moment that usually remains in the heart and memory for a long time. Therefore, it is extremely important that the formalities and the so-called clerical work do not overshadow this important event. It is not so bad if the person you have chosen is Polish, but what if you have decided to marry a foreigner? Without the sworn translation of the wedding ceremony and some of the documents, there is certainly no way around it. Also it is always worth to remember about interpreter in your wedding.

Marriage to a foreigner in Poland. What documents do I need?

The question of which language the wedding will take place in and whether you will need a sworn translator at The Civil Registry office or church should be answered first. It is still rare that the priest or the registrar speaks foreign languages.

For the church or concordat wedding in Poland, a foreigner will need:

– the translation of a Certificate from The Civil registry office stating that there are no circumstances which would exclude the marriage;

– the translation of a Certificate of Baptism and Confirmation;

– the translation of a document confirming that premarital education has been attended.

All these documents should be translated by a sworn translator of the language in which the documents were drawn up.

In order to contract the marriage, a foreigner needs:

– a valid passport;

– the document certifying that the marriage may be celebrated in accordance with the law of a foreign country;

Such a document is issued by the counterparts of The Civil Registry Office of the country of origin, and the embassy of the country concerned may also help to obtain it. If the country of origin does not issue such an application, it should be requested from the district court (the court will issue it at the foreigner’s request);

– the translation of a shortened copy of the birth certificate – the original and a sworn translation into Polish;

– in the case of widows and widowers, a copy of the shortened death certificate of the spouse must be translated; in the case of a divorced person, a shortened copy of the marriage certificate with a note on divorce or a final court decision pronouncing a divorce;

– the statement of the surname which the spouses will bear after the marriage and their children (to be completed on the spot at The Civil Registry Office);

– the foreigner who is not a citizen of any country (the so-called stateless person) and does not have the place of residence in Poland, should present a travel document or a passport issued by the authorities of the country of residence;

– the foreigner who has a refugee status in Poland should present The Geneva Travel Document (the so-called Travel Document) issued by the President of the Office for Repatriation and Foreigners, and the foreigner who has the right to reside in Poland needs a Residence Card.

Statistics show that more and more marriages in Poland are being concluded with persons of another nationality. It is about 10,000 per year, and the number will grow, bearing in mind that the borders are open and people travel a lot and change their place of residence.

– both the bride and the groom must have a valid Identity Card

– a shortened Birth Certificate

– divorcees must have an Identity card, a copy of the Marriage Certificate and a copy of the court judgment confirming the divorce

– widowers must have an Identity Card, an abbreviated Birth Certificate and a copy of the Death Certificate of their spouse.

A maximum of thirty-one days before the wedding, the couple should go to The Civil Registry Office with the above-mentioned documents. At the Civil Registry Office, the document certifying that there are no circumstances which would exclude the marriage is drawn up. This document remains in the Civil Registry Office if the ceremony is to take place there or is issued for the purpose of the concordat wedding.

The presence of a sworn translator is required at The Civil Registry Office if the foreigner does not speak Polish well.

Finally, it is worth mentioning that under Polish law the marriage to a Pole does not guarantee the foreigner either a right of residence or a work permit. Further documents should be applied for at The Voivodeship Office.
